NOTICE ABOUT THE EFFECTS OF ART. 13 OF REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL OF 27 APRIL 2016 ON THE PROTECTION OF NATURAL PERSONS WITH REGARD TO THE PROCESSING OF PERSONAL DATA AND THE FREE MOVEMENT OF THESE DATA
In fulfilment of the obligations pursuant to art. 13 of the 2016/679 EU Regulation (hereinafter “Regulation”), this policy is made available to all those who benefit from the services provided by the companies of the BRESCIA MOBILITÀ GROUP and/or who wish to establish a contractual relationship with them.
2. DATA CONTROLLER and DATA PROTECTION OFFICER
The companies of the BRESCIA MOBILITÀ GROUP have defined an agreement as co-controllers of the processing in order to simplify the relationship with the various companies, avoiding the need to repeatedly request the same data.
These companies are therefore co-controllers of data processing:

3. PURPOSES OF THE PROCESSING, TYPES OF DATA PROCESSED, REQUIREMENT TO PROVIDE DATA
The Companies of the BRESCIA MOBILITÀ GROUP process all the personal data necessary for the provision of the services requested, or in any case for the fulfilment of the relationship between the parties, including the performance of surveys aimed at verifyng customer satisfaction, with a view to improving the services rendered.
In any case, the Companies of the BRESCIA MOBILITÀ GROUP shall only request and process data strictly necessary for the purposes of the processing carried out, including the electronic transmission of “courtesy” information, such as reminders about the expiry of the contract or regarding obligations required by law. Providing data is optional, but failure to do so could compromise our ability to offer the service requested or establish a contractual relationship.
These are usually common data (this category includes all data that allow direct identification, like personal information and images, or indirect identification like tax code, number plate and email address), but for the provision of some services may be necessary to process information falling within the special categories of data as per art. 9 and art. 10 of Regulation EU 2016/679. These special categories referred to in art. 9 of the regulation include data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person’s sex life or sexual orientation. Art. 10 of EU regulation 2016/679 refers instead to the processing of personal data relating to criminal convictions and offences.
4. DATA STORAGE PERIOD
The data provided are kept for the duration of the contractual relationship established and at least for the minimum time required by law. In the absence of such laws, based on the purpose for which the data were collected the Companies of the BRESCIA MOBILITÀ GROUP establish a limited storage period, in any case no longer than ten (10) years from the end of the relationship with the data subject.
With regard to the storage of information deriving from video surveillance systems and the use of travel documents, data storage is limited to seven (7) days. After this term, the data are erased or made anonymous unless otherwise requested by the public safety authorities.
5. RIGHTS OF DATA SUBJECTS
The data subject is entitled to exercise all the rights established by relevant legislation and more precisely to ask for access to personal data concerning him or her, their rectification or erasure, the restriction of processing, as well as to withdraw any consent given or to oppose the processing itself, consistent with the legal obligations with which the Companies of the BRESCIA MOBILITÀ GROUP must comply.
Similarly, the data subject can avail himself or herself of the right to the portability of the data and to lodge a complaint with the Personal Data Protection Authority.
6. DISCLOSURE AND DISSEMINATION OF DATA
Personal data collected may be disclosed to third parties responsible for the performance of related and instrumental activities requiring their processing and to competent authorities in the fulfilment of legal obligations. The data will not be widely disseminated or disseminated for uses not immediately related to the purpose for which they are provided. Data will not be disseminated outside of the European Union.
7. VIDEO SURVEILLANCE AND LOCALISATION SYSTEMS
For the purpose of protecting the safety of persons and assets, video surveillance systems are in operation at the offices of the companies of the BRESCIA MOBILITÀ GROUP, as well as in the areas affected by the related services and in public transport vehicles, with recording of images and sometimes the corresponding audio. The areas and vehicles equipped with these systems are identified by appropriate on-site signage.
For the same purposes, a GPS satellite tracking system is installed on company vehicles. Vehicles equipped with a GPS system are identified by means of appropriate signage on the vehicle itself.
8. PERSONAL DATA OF MINORS
The communication of personal data relating to a minor must be carried out by a parent or guardian. The companies of the BRESCIA MOBILITÀ GROUP do not process any personal data of minors without the consent of a parent or guardian.
Users who are not yet 18 years of age are therefore invited not to disclose their personal data in any way without the consent of their parent or guardian. The companies of the BRESCIA MOBILITÀ GROUP reserve the right to refuse access to the services and do not guarantee the proper result of the activities/services required for any User who has concealed his or her age or has communicated personal data without the consent of a parent or guardian.
9. NAVIGATION DATA AND COOKIES
During their normal operation, computer systems and software for the operation of the web site www.bresciamobilita.it acquire certain data whose transmission is implicit in the use of Internet communication protocols.No personal data is acquired from the site unless it is consciously provided by the user. Software is not used for the transmission of personal information even though software (cookies) is used to monitor - in an aggregate manner and not to identify the visitor - the navigational habits of our customers in order to improve the service offered and make navigation on the site more secure and efficient.
Cookies are generally described as text files containing small amounts of information that, if enabled, are downloaded to the user’s device while visiting the BRESCIA MOBILITÀ GROUP websites.
The cookies used are defined as session cookies, meaning temporary cookies that help the user navigate within the website and remember the choices made during the session, avoiding the use of other techniques potentially damaging to the privacy of the user’s browsing. These cookies are disabled as soon as the website is left using the logout procedure or after the website has not been used for a certain amount of time.
The BRESCIA MOBILITÀ GROUP website does not use advertising cookies and does not use profiling cookies, i.e. cookies that can somehow keep track of customer habits and personal information, or use so-called persistent cookies of any kind, i.e. systems for tracking users.

Technical or system cookies
This type of cookie allows the user to properly navigate the websites and use special features such as access to secure areas of the websites, where available. Without these cookies, it will not always be possible to provide authentication services or guarantee the proper operation of internet websites.
These cookies are not directly defined by the BRESCIA MOBILITÀ GROUP, but are inherent in the software platforms used, therefore they are generated and used automatically. Their use is only for the purpose of general technical operation and do not compromise the user’s privacy by collecting information about him or her.
Cookies for the statistical analysis of performance and of navigation
The BRESCIA MOBILITÀ GROUP uses the Google Analytics statistics platform (Google Inc.) and incorporates the cookies and access modes specified by Google.
This analytical tool is used to collect standard log information used on the Internet and anonymous information on visitor behaviour. Visitors can choose not to send information to Google Analytics for all websites by visiting the Google site at https://tools.google.com/dlpage/gaoptout and following the instructions.
